Schneed, what if his daddy did buy him a house? It's a very fair response to such a question. This is 2nd hand information and there are two sides to every story. However it seems the first guy overreacted a bit. No discrimination has happened as of yet.

Truth doesn't matter. It's an escalation of the discussion that didn't need to happen. He was better off just walking away from the guy and telling his buddies what an idiot the guy is over a couple beers.

What is this? High school? This isn't a case of discrimination, it's just retardation on both parties. Discrimination is what the Supreme Court did recently in Goodyear vs Ledbetter (http://www.time.com/time/business/article/0,8599,1737684,00.html?imw=Y).

Managers shouldn't get into the minutia when two employees have a confrontation. It should be made clear that confrontations in the workplace are not tolerated. The manager should seek to find out what happened, and determine if there was one victim and one aggressor, or two parties contributing to the conflict. But as for making judgments as to whether certain verbal statements are acceptable, managers shouldn't make those judgments because they're so subjective. The manager needs to convey the bottom line: if you had a role, ANY role in the confrontation, then that's unacceptable.

It puts the onus on the employees to manage their emotions professionally when in the workplace. It also puts the onus on them to stay away from people who could cause them aggravation, thereby increasing their chances of steering clear of confrontation in the first place.

Long story short, both people involved here need to grow the eff up.

im with schneed on this. both parties were out of line. and saden, Goodyear has lots of money. sometimes that distorts the truth. but on the flip side, where i work just sent an e- mail to management, saying they are lagging in minority, and women hiring. isn't this kind of reverse discrimination? the one women they promoted, to a pretty high position, is definitely NOT qualified for the job

Interesting stuff, thank you guys, i mean we were just talking about what would be appropriate for the management to do in a situation like this, but i do agree that the lead on duty should have pulled them both aside and probably sent them both home for the day, my other thing is that what if this was an African American and the guy would have been you fucking n-word go back to Africa, wouldn't this fall in the same category ? I'm not trying to insult anyone so i apologize if I'm stepping over the line with that example, but I'm just stating that my buddy is European, so what gives that guy the right to call him Eurotrash and get the f**k out of USA......like excuse me ? I work just as hard as you if not harder I pay taxes just as you do, you know what gives him the right to say that. I agree with what sadden1 said too "what is this high school?" exactly you would think some people would grow the f**k up and be professional at least at work. We'll see what happens today. I'll let you guys know, since the big boss is going to be there I think he'll talk to both of them. Thanks again for the advice it's always good to get some outside input on this.

Discrimination is a serious matter and I don't think one employee calling an African American co-worker the n-word qualifies as discrimination. Certainly, if the assailant employee has a say in your future (i.e. your boss) it does but a co-worker on equal footing does not. If you report the matter to higher up and it persists then it can escalate to discrimination because it would mean management complicity.

I suppose you would have to define what qualified means? Is it experience? Is it education? A combination of both? Personal qualities and likability? Truth is, and I have been guiltily of this myself, that people we can identify with appear more qualified psychologically.

The main problem in this country for minorities is that they're on a whole lagging in terms of both experience and education so right of the bat you're eliminating a large segment of minority population. Certainly there are qualified minorities out there but you have to look hard. Bottom line, at some point we have to break the vicious cycle where the next generation of minorities are still less qualified because they are getting substandard education.

As for the Goodyear case, the Supreme Court ruling was a complete travesty. You know, I have experienced pay discrimination first hand but it was something I had full knowledge of where as Lilly Ledbetter did not. I know, she's naive, still, it was willful discrimination. The ruling the high court came out with was one they pulled out of their asses, it certainly defies logic and reason. I really would have appricated and understood the ruling if they had just come out and said "we need to protect corprate america from descrimination lawsuits" or "we think the award is too much." It is not Justice they sew.
