Another question for the legal minds on this boards. How does prosecutorial misconduct affect the witness testimony or any other evidence in a case like this? How hard will it be for the defense to bring this incident up in the trial itself if it ever makes it that far. Basically can the defense argue that all the evidence this guy was involved with as he built this joke of a case may be tainted and therefore should be inadmissible?

well it isnt his business site, its his personal blog site, which I guess is fine, even if you have sexual jokes, and little kids cussing. But as soon as you have links about your business, and you are promoting yourself, then that good enough to get you fired.

Like I said in the earlier thread. The case is looking more and more like a simple publicity grab every time they go to court. What a shame that this type of crap goes on. Guilty or not the justice system looks like a cracker jack toy.

the defense attorney they had on 980 said that if this guy was the prosecutor for MD, he wouldn't have a job by monday.

It is funny that all this is happening, now? WTF you would think someone had noticed his myspace and atleast complained about it, like former defendents, etc. Heck maybe even the state??? This guy seems like a totally douche, and not who you would want to be a state prosecutor. I am not going to deny that I want to go to one of this guys parties, bc they look sick lol...

The case could get dismissed on the pretrial motion to dismiss for prosecutorial misconduct. Thie guy was obviously a bonehead trying to privately profit from his public position.

However, if the motion to dismiss is denied, the prosecutor's conduct will not be an issue at trial. It's simply irrelevant to the charges.

Could it get dismissed without prejudice or is that not suitable in this case? Or is that even a legal option in a criminal case?

Seems to me that Taylor when all is said and done in the criminal case could sue for defamation. Is that a possibility?
