My 17 yr old nephew yesterday recued a brother and sister around the ages of 7 who got caught in a rip current. He was surfing at Va Beach when he noticed the two kids struggeling in the water pulling each other under. He paddled over to them and had them get up on his surfboard and allowed the rip current to take them out. After it had stopped pulling them out he started back in as a lifeguard came to help. They got the two kids back to shore and he left before the parents had a chance to thank him. Scarry thing is the parents had no clue anything was wrong and this went on for around 5 minutes

That said, why does the judge have the ability to put her in jail for contempt for not shutting down her facebook feed. She may be stupid, but posting things like that to facebook is not illegal. I don't understand how he can even order something that ridiculous. |

i agree with you on shutting down facebook, i dont think that falls within his right. I would have simply given her the max penalty for DUI and fine. 6 months jail time, loss of license, 500 hours community service, max fine i think is $2,500...I think that sends stronger message than shutting down facebook. |

The Judge could have said something along the lines of: "If you shut down the facebook page making light of drunk driving, I will consider it an act of contrition when fashioning your sentence. If you don't, I will consider [I]that[/I] when determining your sentence."

Are you saying that he could have done that instead of what he did? Because from the article (obviously not 100% gospel to the court proceedings) said that the judge "ordered" her to, and then when she didn't cited her with contempt. A contempt citing doesn't seem to fit the way you described it. |

@Cred - If he sent her to jail for contempt, then it would seem to me that would have to be for failing to comply with an order to shut it down. Not sure where he gets the authority to do that - while stupid, doesn't strike me as illegal. At the same time, trial judges have a lot of discretion in their sanctioning authority.

Gotcha. I agree with the way you said it in your earlier post, Judge could have given her the option, and used her choices at the sentencing. Making it an order, then citing contempt just seems the wrong way to go about it to me. |

Good luck, man...great thing to do. My wife and I want to rescue our next dog when we decide to get another one. The only scary part is possible, unknown medical costs but it's a decision and commitment you have to go into all or nothing.
