Labor Law Question!
 
I have a question about Virginia labor laws. Basically my girlfriend works for a company that had her sign a contract when she was hired saying she had to work overtime, my question, is there a limit on it. I mean, she was at work today from 6:30AM till 10:15 tonight, which is ridiculous, in my opinion. My question is this, is there a maximum overtime per day (or even week because days like this aren't rare) that applies to her even though she said she had to work overtime in her contract?

I believe VA has no specific labor laws as it applies to overtime so the Federal FLSA overtime rules are all that apply. There are no constraints on the amount of time. As long as she gets paid 1.5 her wage(for non-exempt) they are clear. If she is exempt then they don't even have to pay her for overtime by law. What is her profession and how are they calculating her overtime and how much are they paying her for it?

But also if she works over 40 hours a week I believe she is required by law to be given benefits.

I would suggest contacting the VA. Department of Labor.

She gets time and a half, but anyone who works OT knows that after about 50 hours, you don't see a whole lot of that overtime pay (sometimes you get it w/ your Tax refund) . Thanks for the advice guys1
