thanks, and i just talked to my lawyer. he seems to think its a waste of time. hopefully, he is right:)

Sounds like a waste of time - if all of the facts you presented are accurate, it'll get kicked on demurrer (or whatever you have for a motion to dismiss in PA). However, if they have a witness who will testify that your daughter was somehow complicit, that could get trickier.

For the record, I had a 1983 Mazda GLC. In 1993. Nobody ever tried to steal it.

Why are you paying for a lawyer when your ins. co. will provide one to represent them and you?

If you didn't press charges against the kid who stole it then I would. If the statute of limitations is up you may have problems. If no charges were filed there is little or no proof that the car was stolen.

just a bump, to let you guys know how this is playing out( not sure if anyone cares?) talked to the insurance companies lawyer, and he thinks the whole thing is a joke. when the car was originally stolen, i told the police i wanted to press charges, just to make sure i covered all my bases. well, for some reason, and i think it was because the kid was only 15, he never files those charges. so i might have to re file. but he said this case is pretty much cut and dry. so, once the judge hears my side, the whole thing will be dismissed

That's good to hear and I guess your letting your ins. co. lawyer handle the case. You did mention back in the thread that your worried about having your ins. canceled. In most if not all states they cannot cancel you over a comp. claim which a stolen car would be a comp claim.

The insurance company should hire you a lawyer. They do this a lot. They fight each other like this. I would try to stay out of it if I were you.
