I would understand your resoning more so if Matty was running a big counterfit ring and trying to sell copied downloaded music as the origianl works and making a profit. But he is not, there is no money changing hands.

thats kinda the point that there is no money changing hands. Had you wanted that CD, you were supposed to go and pay for it, just like Matty did.
