I like to think there was more happening then we all know. I think the team had a plan as to how to handle the offseason. The punishment, although some would like to say both teams knew one was coming I don't think they thought it would be as big as it was if any at all. See the two teams put the league in a bad spot. No way the NFLPA would agree to not file suit, and no way would the league punish them with out risking proving there was collusion.
On top of all this there might have been agreements made with agents in order to get deals done quick prior to FA and prior to the league punishing the two teams. I think the team went about its normal routine getting FA's while trying to figure out what to do next about their plan. Part B of the plan was to also wait and see what Fletcher would get offered on the open market and match it. As far as we know the top two LB's have not even had a nibble as of yet. So although Fletcher sits there and it looks bad on us I think he's waiting to see if we are going to get any money back to resign him.
As the media puts it this should be a slam dunk for both teams, legally both teams did not break any laws and did not violate any CBA cause there was not one, on top of that the league approved the deals when they had the opportunity to turn them down and force the two teams to either not make new deals or atleast rework them to fall with the perimeters set out. The league didn't, they approved the deals. Personally there has to be an appeal of the process to show they don't agree with it and give the league the opportunity to give it back or come to some form of agreement. If that does not happen then a trial might be in the works.
But to answer your question I think the fight to get some of the money back is now the new plan is to try to get Fletcher signed.
