2nd-degree murder?

If Canada's homicide laws are the same as the U.S., this is ridiculous. How can this NOT be premeditated!?!?!?

The psychiatric exam is pointless too, this man can NOT be mentally stable.

It's like they're protecting this monster.

That's what I was thinking but it seems that the crime can't be classified under first degree murder in Canada (http://en.wikipedia.org/wiki/Murder#First_and_second_degree) unless it's determined that it was planned and deliberate.

In Canada, murder is classified as either first or second degree.[31] (http://en.wikipedia.org/wiki/Murder#cite_note-30)

First degree murder is a murder which is (1) planned and deliberate, (2) contracted, (3) committed against an identified peace officer (http://en.wikipedia.org/wiki/Peace_officer#Canada), (4) while committing or attempting to commit one of the following offences (hijacking an aircraft, sexual assault, sexual assault with a weapon, aggravated sexual assault, kidnapping and forcible confinement or hostage taking), (5) while committing criminal harassment, (6) committed during terrorist activity, (7) while using explosives in association with a criminal organization, or (8) while committing intimidation. [32] (http://en.wikipedia.org/wiki/Murder#cite_note-31)
Second degree murder is all murder which is not first degree murder.

If he is metally ill they won't get a first degree conviction. You need to prosecute what you think will stick. Second degree will stick.

When the showed the psycho who did it being escorted by the police I laughed.....

Anyone on this board could have jumped in. Just wait until you see the little shitbag on the news.

Hesscl34 could have pinned him while we beat him like a pinata.

What a disgusting display of cowardice from the other passengers.

... I feel ashamed as a human that no one stepped up and helped him.... his poor family.

I think its very easy to look at this situation and state what should have happened. The fact of the matter is these people were on a bus, in their own world. Suddenly a very unexpected, violent act occurred. As a social worker who is quite familiar with both psychological and social theory, I can only assume that the fight or flight response kicked in and people did what they felt they had to to survive. No one on this board was on that bus and can say for sure what emotions and feelings were running through these peoples minds.

I find situations like the older gentleman who was hit by a car in the street in Hartford to be much more troubling.

I agree that as humans we need to look out for one another, but this is a very unique situation, and it must be looked at for what it is. No one could have helped that young man, he never had a chance. The people on that bus are going to need some serious help in getting through this, and judging them for their lack of action is just not something we should be doing.

Funny, but 'we' used to deal with these things far better before the world got all 'touchy-feely'.

I have to believe stepping on a bus with a meat cleaver is "premeditated".

Maybe you aren't old enough to remember a time when, if you got caught acting up as a kid, you'd get belted by the adult neighbor who caught you, THEN you got dragged home to your irate parents who repeated the process.

Now everyone is afraid to even raise their voice to a kid in case they get sued for assault.

It may seem like a minor thing but it's why we have the lack of accountability we currently have, IMO.
